An Osun State High Court sitting in Osogbo presided over by Justice Oyebola Ojo has ruled that Hilton Hotel owner, Dr. Rahmon Adedoyin, and six workers have a case to answer over the death of an MBA student of Obafemi Awolowo University, Ile-Ife, Timothy Adegoke.
The defendants’ counsel led by Yusuf Alli, SAN has after the close of prosecution case at the last sitting informed the court of the intension of the defence to file a no- case submission .
According to the no- case submission filed by the defendants’ it was averred that Adedoyin and others do not have a case to answer because the prosecution has failed to establish any case against them.
But in his reply, the prosecutor, M .O Omosun said that the prosecution has made out a case against the defendants that would warrant them to enter their defence, Omosun then urged the court to call on the defence to open their defence.
However, the trial judge while rulling on the defendants no- case submission application held that the “Evidence before the court revealed that Timothy lodged in the hotel owned by Adedoyin. Adesola who is the 7th defendant, the receptionist received the log book”
The court also held that the wife of the deceased spoke to him while in the facility, but he could not be reached afterward by the wife.
She called on the defendants to enter their defence.
